These terms apply to enquiries made through this website and to diving activities and trips booked with Aqua Nomads. Booking with us means accepting them. Please read them alongside our disclaimer and our privacy policy.
Enquiries and bookings
An enquiry sent through this website is a request, not a booking. Nothing is held for you and no payment is taken at that point. A booking exists only once we have confirmed it to you in writing, with the dates, the activity and the price on it.
Prices
Prices are quoted in Indian Rupees and include taxes unless we say otherwise. The price we confirm to you is the price that holds. Marine park fees, permits, equipment hire beyond what a package includes, and travel to and from the centre are yours unless the confirmation lists them as included.
Certification, experience and fitness
- You must hold the certification a dive requires and be able to show the card and a logbook - or complete the course with us first.
- You must complete a diver medical declaration honestly. A yes answer means a doctor must clear you to dive before you get in the water.
- Minimum ages follow your certifying agency’s standards. Divers under 18 need a parent or guardian to sign.
- If you have not dived recently we may require a refresher before an open water dive. That is a safety call, not an upsell.
Our right to refuse or end a dive
The instructor or divemaster running a dive has the final say. We may refuse or stop a dive - and you may be asked to leave the water or the boat - if conditions are unsafe, if equipment fails, if you are under the influence of alcohol or drugs, if your medical or certification status is not what was declared, or if your conduct puts anyone at risk. A dive ended on safety grounds is not refundable, though we will offer an alternative where one exists.
Weather and cancellation by us
Diving in the Andamans is weather-dependent. If we cancel for weather, sea state, permits or safety, we will first offer to move you to another day or another site. Where that is not possible you are refunded for the activity that did not run. We are not liable for the cost of flights, ferries or accommodation booked around a dive we had to cancel - travel insurance is what covers that.
Cancellation by you
Cancellation terms are stated on your booking confirmation and vary by trip length. As a general rule, a course or day trip cancelled more than 48 hours ahead is refunded in full and one cancelled inside 48 hours is not; a multi-day package follows the schedule on its own confirmation. A no-show is treated as a cancellation on the day.
Insurance
We strongly recommend dive-specific travel insurance covering hyperbaric treatment, evacuation and trip cancellation. Some trips require it and say so. Our own liability cover insures our operation; it does not cover your medical costs or your travel.
Equipment
Equipment we hire to you remains ours. Return it in the condition it left in, fair wear excepted. Loss or damage caused by misuse is chargeable at replacement cost.
The environment
No touching, no chasing, no collecting; nothing taken off the reef and nothing left on it. Marine park rules apply on every site we dive, and divers who ignore them are brought out of the water.
Liability
Nothing in these terms limits liability for death or personal injury caused by our negligence, or anything else that cannot lawfully be limited. Beyond that, our liability for any booking is limited to the amount you paid for it, and we are not liable for indirect or consequential loss.
Photography and media
We sometimes photograph or film dives. Tell us if you would rather not appear and we will keep you out of it; otherwise we may use the images to show the diving we do.
Complaints and jurisdiction
Tell us on the day if something is wrong - almost everything is fixable while you are still here. Anything left unresolved should be put in writing through our contact page. These terms are governed by Indian law, and the courts of the Andaman and Nicobar Islands have jurisdiction.
Changes
We may update these terms. The version that applies to your booking is the one published when we confirmed it.
